Visa cancellation undermines presumption of innocence
Australian Greens Senator Kerry Nettle condemned Minister Andrews'
decision to cancel Dr Haneef's visa and detain him, despite the court
having granted him bail.
"The court has granted Dr Haneef bail but the government has decided to
override a judicial decision and lock him up anyway," said Senator Kerry
Nettle.
"The federal government's decision undermines Dr Haneef's chance of
getting a fair trial by cancelling his visa today.
"The government has effectively declared Dr Haneef guilty before he even
gets his day in court.
"Immigration detention is not meant to be a jail of last resort when the
government doesn't like a court's decision.
"This visa cancellation by the Government shows how broad the scope is
for the Immigration Minister to cancel visas and how this power can be
used politically.
"The federal government is pre-empting the court case by cancelling his
visa.
"Dr Haneef will now be locked up in immigration detention centre away
from the media.
"What chance does he have of gaining justice, when the Minister has
effectively declared him a terrorist?" concluded Senator Nettle.
