Greens stop SLAPPs

The ACT Assembly today passed Greens MLA Deb Foskey's Protection of
Public Participation Bill, following its initial introduction in 2005,
an Assembly Committee inquiry which concluded in 2007, and its
subsequent redrafting.

This Bill is part of a Greens national project to introduce anti SLAPP*
laws in every jurisdiction. 

"This Public Participation Act is an Australian first, providing
protection against legal action which is designed to silence people
wanting to contribute to public debates" Dr Foskey said today.

"As the 'Gunns 20' are well aware, the burden of an unfounded legal
attack can be crippling and enormous."

"Our laws will protect people who give up their time and money, and
often peace of mind, to fight to help those who cannot help themselves,
future generations, other species, and the rest of us.  These are the
people who should receive Orders of Australia, and other civil awards.
They are true heroes."  

"I am happy to take this opportunity to applaud the Government and the
Liberal Party for their support for my Bill, which reinforces the right
of political expression." 

"The passage of this Bill with the eventual support of all parties is an
illustration of how the Assembly works best when parties cooperate on
important legislation."

"This Bill adds teeth to some provisions of the ACT Human Rights Act.
In the absence of a national or enforceable Bill of Rights, legislation
like this is essential to protect democratic freedoms.  I hope the
Commonwealth follows the ACT's lead" Dr Foskey said.
