Immigration Minister's review of Haneef visa cancellation: inevitable
and damning

Greens Senator Kerry Nettle today called for a change in immigration
laws to stop the Minister cancelling visas of people suspected but not
convicted of criminal offences.

The call comes in light of the Immigration Minister's instruction that
the Australian Federal Police review the information on which the
Minister based his decision to cancel Dr Haneef's visa.

"This decision was inevitable in light of the public unravelling of the
case against Dr Haneef," Senator Nettle said.

"The Minister's extraordinary decision to cancel Dr Haneef's visa was a
clear breach of the principle of the presumption of innocence, and
highlights the inappropriate powers conveyed on the Minister under this
part of the Immigration Act.

"If the review results in Dr Haneef's visa cancellation being overturned
then the Minister's original decision will be damned as political and
not a proper use of his statutory powers.

"The Greens will move to amend the Migration Act to ensure that it
cannot be abused as a backdoor method for locking up political
prisoners."
