HIGH COURT COMPENSATION LITIGATION LOTTERY A FAILURE 
Cunningham MP Michael Organ has again called on the Federal government
to investigate establishing a no fault comprehensive injury and death
scheme following Shoalhaven City Council insurer's decision to launch a
High Court appeal after being found liable to pay $743,000 in
compensation to a South Coast woman whose husband was killed when a tree
fell on his home. 

"The legal technicalities take second place here. What matters is that
our community deserves better than continuous legal squabbling about who
is, maybe, or isn't at fault in circumstances like this. Michael Organ
said.

"The focus of government should be on accident prevention,
rehabilitation, and appropriate compensation for people regardless of
fault.   It is a failure of government when one family can be
compensated while another family is forced to rely on meagre Centrelink
payments for the rest of their lives all because one lawyer has a better
or worse day in court. 

"Equally, every dollar that is spent on legal fees is a dollar not spent
on care for the injured and contributes to the cost of insurance
premiums for community groups and small business.

"Government must follow my lead and consider a comprehensive No Fault
National Injury Scheme. The compensation litigation lottery must be shut
down." Mr Organ said.
